Court orders National Sports Commission To Pay N9.9m For Items Supplied It

A FCT High Court, sitting in Maitama, Abuja, has ordered the National Sports Commission (NSC) to pay N9. 9 million to three companies for items supplied it.

The companies are Zeminex Nigeria Ltd, Micnovos Nigeria Ltd and B.N Donager Ltd.

Justice Jude Okeke held that the defendant, NSC, did not deny the award of the contracts for the supply of the items to the plaintiffs, but contended that the contract was not executed.

He said that the documents and evidence presented to the court by the plaintiffs were such that the defendant could not deny.

“In the circumstance, the court will enter judgment for the plaintiffs.

“The defendant is directed to pay to the plaintiffs N9. 9 million being the total sum of items supplied to it without payment for them, and N30, 000 to the plaintiffs as cost for the suit,’’ the trial judge ordered.

Okeke said that the defendant did not seriously questioned the plaintiffs’ claims given the unequivocal sequence of events as proved by the documents issued under the hands of the defendant’s officials.

He further held that the defendant did not question the performance voucher given to the plaintiffs by its officials on both the ordering and the supply of the items.

“ There is no gain saying that it is investigating the source of the plaintiff’s evidence of performance, the defendant is indirectly raising a defence of fraud to the plaintiffs’ claims.

“Regrettably, the particulars of the fraud as requested, was not provided to the court.

“In the light of the forth going, the court holds that the defendant’s affidavits has not disclosed the defence on the merit to justify  the issues granted him to defend the suit under Order 21  Rule 4 of the Rules of Court 2004, ‘’ Okeke held.

The News Agency of Nigeria (NAN) reports that the plaintiffs on April 5, 2016, filed the suit against the defendant (National Sports Commission) and urged the court to compel it to pay them the amount owed for various items supplied.
